Brain for Builders

Terms and conditions

Version 1.1 · 30 October 2026

1. Who we are and what these terms cover

Brain for Builders is sold by Jaynie Ball, trading as Illuminate Co, a sole trader based in Auckland, New Zealand ("we", "us", "BfB"). You can reach us at hello@brainforbuilders.co.nz.

These terms apply to every purchase of a Brain for Builders pack, to any support you buy from us, and to your use of anything we supply: the pack sheets, the Brain files, templates, prompts, videos, recordings and any updates. By buying the pack, downloading it or using any part of it, you agree to these terms.

If you don't agree with these terms, don't buy the pack. If you've already bought it and don't agree, don't use it and contact us.

These terms were last updated on 30 October 2026. The version on our website is the current one and replaces any copy in the pack if the two differ.

2. Feedback and reporting gaps

This is a beta, and we want to hear about gaps. If a sheet is wrong, unclear, missing a step, or describes something that no longer works, email hello@brainforbuilders.co.nz with the sheet number and what happened. The pack includes a built-in way for Claude to draft that email for you. You decide what goes in it and you send it.

We will look at every report. We decide what, whether and when to change in response, and reports do not create any obligation on us beyond what section 7 says about updates.

The beta is a two-way deal. You get the pack at a reduced price and free updates for the life of the product. In return, you help us build it by telling us what works and what doesn't. So anything you send us about the pack, including suggestions, ideas and feedback, may be used by us to improve the product, and the beta price and free updates are your reward for it. There is no separate payment or credit, and no obligation of confidence, unless you tell us in writing at the time that something is confidential. This does not apply to your business information, which stays yours.

3. Who the pack is for

Brain for Builders is built for construction companies and sold for business use. It is not sold for personal, domestic or household use.

By buying the pack you confirm that you are buying it in trade, for use in a business, and that you have the authority to agree to these terms for that business. Where you buy it for a company, the company is bound by these terms as well as you.

You are responsible for everyone in your business who uses the pack, including staff and contractors, and for making sure they follow these terms.

4. What you are buying

The pack is a set of digital documents and files: setup sheets, Brain files, templates, prompts and supporting material, delivered as a download. It is a framework and a set of instructions for setting up and using Claude, an AI program made by Anthropic, inside your building business.

The pack is self-implemented. You set it up yourself, inside your own Claude account and your own systems, following the sheets. We do not set it up for you. Section 8 explains the support that comes with the pack and the one-on-one help you can buy on top.

The pack is not software. It does not include Claude, a Claude subscription, Microsoft 365, Google Workspace or any other program or service. You need to buy and hold those yourself, on whatever plan you choose, and their terms apply to your use of them.

The pack is sold as a beta. That means it is an early version, released to be tested in real businesses. It may have gaps, errors or steps that don't work as described. The beta price reflects that. Section 2 explains how to report a gap.

5. Licence, ownership and sharing

We own the pack. Everything in it, including the structure, the folder architecture, the Brain files, the rules, the sheets, the wording, the designs and the Brain for Builders name and logo, is our intellectual property and is protected by copyright. Buying the pack does not transfer any of that to you.

What you get is a licence: a non-exclusive, non-transferable right to use the pack inside one business, for that business's own purposes, for as long as you comply with these terms. One purchase covers one business and any number of people working in it.

You may copy the pack files within your business, upload them to your own Claude account and your own cloud storage, and change the Brain files, templates and contact lists to suit your business. Those changed files are for your business only and remain subject to this licence.

You must not share, give away, sell, rent, lend, publish, post online or otherwise distribute the pack or any part of it, changed or unchanged, to anyone outside your business. You must not use the pack, or anything taken from it, to make a competing product or to set up other businesses. You must not remove any copyright notice or mark from it. None of this stops you using your own business information, or anything you created yourself without the pack.

If we reasonably believe you have breached this section, we may suspend your licence while we contact you and give you a reasonable chance to put it right, where that is possible. If the breach is serious, can't be fixed, or isn't fixed in the time we give you, we may end your licence by written notice. Once it ends you must stop using the pack and delete every copy, other than any you are legally required to keep. We may also take whatever other action the law allows.

Your own information is yours. Anything you put into your Brain files, your folders or your Claude account, including your company details, contacts, rates, documents and job records, belongs to you. We never see it, hold it or have access to it. What we do receive is what you send us directly: your purchase details, emails, problem reports and feedback. We handle that under the Privacy Act 2020 and use it only to supply the pack, send updates and deal with what you've asked.

6. Price, payment and refunds

The price is the one shown on our website at the time you buy, in New Zealand dollars, plus GST. Payment is made in full at checkout through our payment provider, and the pack is delivered as a download once payment clears. The payment provider's own terms apply to the payment.

Because the pack is a digital download that you set up yourself, we cannot take it back once it has been delivered, and we cannot control how it is used. For that reason there are no refunds on the beta pack, other than at our sole discretion.

In particular, we do not refund because you could not set it up, did not set it up, did not use it, changed your mind, or because Claude, Anthropic, Microsoft, Google or any other provider changed something, charged you or did not work the way you expected.

If the pack itself is wrong, unclear or missing a step, that is our problem to fix. Tell us (section 2) and we will correct it and send out the update at no charge. That is how we deal with gaps, rather than by refund.

Paid one-on-one support (section 8) is prepaid specialist support and is not refundable.

7. Versions and updates

Every pack carries a version date. The pack describes Claude and the connected services as they worked on that date. Those services change often, without notice to us, and screenshots, menu names, settings and steps will date. A pack is correct as at its version date and we make no promise that it is correct after that.

Beta purchasers receive updates to the pack free of charge for the life of the product. "The life of the product" means for as long as we continue to publish Brain for Builders Head Start in its current form. If we stop publishing it, retire it, replace it with a different product, or sell or close the business, free updates end. We will give reasonable notice where we can.

Updates are sent to the email address you bought with. It is your responsibility to keep that address current with us, to read the updates, and to apply them. We do not apply updates to your setup for you. If you choose not to apply an update, you are choosing to run an out-of-date version, and anything that follows from that is your responsibility.

An update may add, change or remove content. Updates are improvements and corrections to the pack, not a promise to fix every problem or to keep pace with every change the software providers make.

After the beta, updates for new purchasers will be on terms published on our website at the time, which may include a subscription. Those terms will not reduce what beta purchasers have been promised in this section.

8. Support

Support comes in four layers.

Built in. The pack is designed so you can help yourself. The sheets, the FAQ and the built-in prompts are the first place to look, and once the sheets are in your Brain folder, Claude can answer most "how do I" questions from them.

By email, free. If something in the pack is wrong, unclear, missing a step or no longer works, email hello@brainforbuilders.co.nz and we will sort it at no charge. The pack includes a built-in way for Claude to draft that email for you. Section 2 explains how this works.

Anthropic, for Claude itself. Claude is Anthropic's program, and Anthropic provides its own help centre, documentation and support for it. Problems with your Claude account, plan, billing, usage limits, sign-in, the apps, the browser extension or a feature that isn't working go to Anthropic, not to us. We can't fix Claude, see your account or speak to Anthropic on your behalf.

One-on-one, paid. If you want us to work through your own setup with you, "Brain behind the Brain support" is available in one-hour blocks at the rate published on our website, plus GST, payable before the session. Before a paid session we may ask you to complete a short form confirming what you have already tried and describing the problem, so the hour doesn't start cold. If you cancel a booked session, half the fee is charged. If you cancel within four hours of the start time, or don't turn up, the full fee is charged. Rescheduling with more than four hours' notice is free.

Support is help with setting up and using the pack. It is not IT support for your computer, your Microsoft or Google accounts, your network or your devices, and it is not business, accounting, legal or construction consulting. If you want that, it is a separate engagement on separate terms.

We will use reasonable care and skill in providing support. We cannot promise that any particular problem will be solved, because many of them sit inside software we don't control.

Support sessions are booked by arrangement and depend on our availability. There is no guaranteed response time for emails to hello@brainforbuilders.co.nz.

9. Claude, Anthropic and other third party software

The pack is built around Claude, which is made, owned and operated by Anthropic. We do not own Claude, we are not part of Anthropic, we are not endorsed by or affiliated with Anthropic, and we receive no payment or commission from Anthropic or anyone else for recommending it, any plan, or any other product. Claude and Anthropic are their trade marks.

We do not control Claude. We cannot control what it does, what it says, what it gets wrong, what it can reach, what it costs, what plans and limits apply, what features exist, or what Anthropic changes, adds, removes or discontinues, and we are not responsible for any of those things. Anthropic may change or withdraw Claude, its features, its pricing or its terms at any time, and that may affect how the pack works or whether parts of it work at all.

Your use of Claude is governed by Anthropic's own terms of service, usage policies and privacy policy, which you agree to directly with Anthropic when you open an account. You are responsible for reading them, complying with them, and understanding how Anthropic handles your information, including any settings about whether your conversations are used to train its models. We do not restate their terms, because they change and we don't control them. Check the current versions on Anthropic's website.

The same applies to Microsoft 365, Google Workspace, Apple, Todoist, Chrome, Payhip and any other program, app, extension, connector or service the pack mentions or that you choose to connect. Each is owned by someone else, each has its own terms, and we are not responsible for any of them.

We refer to these products by name only to describe how the pack works with them. Mentioning a product is not a recommendation that it is suitable for your business, secure, reliable or fit for any purpose.

10. Guidance only, and AI makes mistakes

Everything in the pack is guidance: information about how we have set Claude up for a building business and what we have found works. It is not professional advice of any kind. Nothing in the pack, in any update, in any support session or in any output Claude produces is legal, accounting, tax, financial, insurance, health and safety, engineering, building, regulatory or compliance advice, and you must not treat it as such. Where you need that, get it from a suitably qualified person.

AI makes mistakes. Claude can produce output that is wrong, incomplete, out of date, invented, or confidently stated and still wrong. That includes numbers, dates, names, quotes, prices, quantities, legislation, standards, contract terms and anything else. The rules in the pack are written to reduce this. They do not eliminate it, and Claude does not always follow them.

You must check every output before you rely on it, act on it, send it, file it, pay on it or give it to anyone else. This applies with particular force to anything with money or legal effect attached: estimates, quotes, tenders, variations, payment claims, invoices, contracts, notices, correspondence with clients, suppliers, subcontractors, councils and authorities, and anything to do with legislation, standards or compliance. Checking those is your job, not Claude's and not ours.

The pack may describe or reference legislation, standards, codes or industry practice. Those references are general, may be out of date, may not apply to your situation, and are not a substitute for the current official source or for qualified professional input.

An output from Claude is your document, produced inside your account from your instructions and your information. We did not produce it, we have not seen it, and we are not responsible for it.

11. Your responsibilities

You are responsible for:

  • Following the setup instructions in the sheets. The pack works best when it is set up as described. If you skip, change or shortcut the setup, the Brain may not behave as the sheets describe, and that is your choice.
  • Your Claude account, your plan, its cost, its usage limits and anything done through it, by you or anyone you give access to.
  • Keeping your own information backed up. Claude is not a backup. Files, chats, memory and projects can be lost, changed or become unreachable, and we are not responsible if they are.
  • Keeping your accounts, passwords and devices secure.
  • Deciding what information you give to Claude and to any connected service, and whether that is appropriate for your business, your clients, your staff and your contracts.
  • Complying with the law in how you use the pack and Claude, including the Privacy Act 2020 in relation to personal information about your clients, staff, subcontractors and anyone else, and any confidentiality obligations in your contracts.
  • Every decision you make, every action you take, every document you send and every payment you make, whether or not Claude was involved.
  • Checking that your business insurance covers the way you work. We do not know your policy and cannot tell you whether it does.
  • Anyone in your business who uses the pack, and anything they do with it.

You must not use the pack or Claude for anything unlawful, to infringe anyone's rights, or in breach of Anthropic's usage policies.

12. What the pack does not cover

The pack is a framework for organising information, email, calendar, files and everyday admin inside a building business. It is not, and must not be used as, a substitute for any of the following, and we take no responsibility for any of them:

  • Health and safety systems, site safety, hazard management, inductions or anything required under the Health and Safety at Work Act 2015.
  • Structural, engineering, architectural, surveying, fire, geotechnical or any other design or technical work, or any sign-off, certification or producer statement that must come from a licensed or qualified person.
  • Licensed building work, restricted building work, consents, code compliance, inspections or any obligation under the Building Act 2004 or the Building Code.
  • Legal, accounting, tax, GST, PAYE, payroll, financial, banking, insurance or employment matters, or compliance with the Construction Contracts Act 2002 or any other legislation.
  • Contract administration where the contract requires a particular form, process, timing or signature. The pack can help you draft; it cannot make a document valid or compliant.
  • Payment claims, payment schedules, variations, invoices, quotes, estimates and tenders. The pack may help you prepare them. Whether they are correct, complete, priced properly and issued on time is your responsibility.
  • Site diaries, site photos, quality records, inductions, time sheets or any record you are required to keep in a particular form.
  • Transactional or financial data handling, bookkeeping or accounting records.
  • Running or improving your business. The pack sets up a tool. It does not tell you how to run a building company and it does not guarantee any outcome for your business.

If the pack happens to touch on any of these, it does so only to show where a file might be kept or how a draft might be started. It is not a system for doing them.

13. Connections, permissions, actions and your information

The pack describes how to connect Claude to your email, calendar, files and other services, and how to use the browser extension and scheduled tasks. Every connection and every permission is set by you, inside your own accounts, and can be changed or removed by you at any time. We cannot set them, see them or change them.

Anything Claude can reach, read, draft, send, move, delete, change, buy, book or do, it can reach and do because you gave it permission to. Everything Claude does through any connection, extension, scheduled task or permission you grant is done at your own risk. That includes emails sent, files moved or deleted, calendar events changed, purchases or bookings made, forms submitted and anything else done in your name, whether you asked for it, whether it was what you meant, and whether or not the pack's rules said it should ask first.

The pack's rules tell Claude to draft rather than send, to ask before acting, and to never make up numbers. These are instructions, not controls. Claude can and sometimes does ignore them, especially where the setup has not been followed or a project has been created without the Brain. We do not guarantee that any rule will be followed on any occasion.

The browser extension can act in web pages on your behalf. Its capability is open-ended and we have not tested, and cannot test, every site or action. We take no responsibility for anything done through it.

Scheduled tasks run on their own without you watching. Anything a scheduled task does is your responsibility.

Who can see your Brain is decided by your own folder and account permissions, not by us. If you put your Brain in a shared folder, everyone with access to that folder can see and change it. Access control is your responsibility.

Where you follow the connected path, your information stays in your own storage. Where you follow the inside-Claude-only path, it sits inside your Claude account under Anthropic's terms. In either case we never hold, see, receive or process any of it, and we have no way to recover it for you.

If you send us a problem report (section 2), send only what is needed to describe the problem. Do not send us client information, personal information about staff or others, passwords or financial details. If you do, we will delete it, and we are not responsible for having received it.

14. No guarantee of results, limitation of liability and the Consumer Guarantees Act

What we can and can't promise. Everything we say about Brain for Builders comes from using it ourselves, in a real building business, every day. That part is true. What we can't promise is that you'll get the same result, because the result depends on two things we don't control: whether you follow the setup and keep using it, and what Claude, a program we don't own, does on the day. So the pack is supplied as it is. We don't promise it is error-free, that it will work with your particular setup, devices or software versions, that Claude will always behave as the sheets describe, that any feature will keep working, or that it will save you time, win you work or change your business. Our experience is ours. Yours is up to you.

Consumer Guarantees Act. You are buying the pack in trade, for business purposes. You and we agree that the Consumer Guarantees Act 1993 does not apply to the pack, to any support we provide, or to anything else we supply under these terms, and that it is fair and reasonable for us both to be bound by this exclusion. To the extent the law allows, all guarantees, warranties, conditions and representations that would otherwise be implied by law are excluded.

Limit on our liability. To the fullest extent the law allows, we are not liable to you or to anyone else for any loss, cost, damage or expense of any kind arising out of or in connection with the pack, any update, any support, Claude or any connected service, however it arises, including through negligence. That includes loss of profit, revenue, business, contracts, data, information, goodwill or opportunity, and any indirect, consequential, special or punitive loss, and any loss caused by an error, omission or action of Claude, Anthropic or any other third party.

If, despite this section, we are found liable to you for anything, our total liability for all claims together is limited to the amount you paid us for the pack, or for the support session the claim relates to, whichever applies.

You cover us. You will cover us for any claim, loss or cost we suffer because of your use of the pack, anything done through your Claude account or connections, your breach of these terms, or your breach of Anthropic's or any other provider's terms, except to the extent the loss was caused by our own breach of these terms or our own negligence.

Nothing here limits what can't be limited. Nothing in these terms excludes or limits any liability that cannot be excluded or limited by law, including under the Fair Trading Act 1986 where it applies.

15. Changes to these terms, governing law and contact

We may change these terms at any time by publishing the new version on our website. Changes apply to purchases made after they are published. For existing purchasers, changes apply to updates and support provided after publication, but we will not use a change to take away the free-updates promise in section 7.

If any part of these terms is found to be unenforceable, the rest still applies. If we don't enforce a term on one occasion, we can still enforce it later. These terms are the whole agreement between us about the pack and replace anything said or written before you bought it, including anything on social media or in marketing.

These terms are governed by New Zealand law, and the New Zealand courts have exclusive jurisdiction over any dispute. If you are outside New Zealand, you buy on the same terms and the same law applies.

If you have a problem with the pack, talk to us first. Most things can be sorted with an email.

Brain for Builders

Privacy policy

30 October 2026

Who we are

Brain for Builders is run by Jaynie Ball, trading as Illuminate Co, a sole trader in Auckland, New Zealand. This section explains what personal information we collect through this website and the pack, what we do with it, and how to ask us about it. We handle personal information under the Privacy Act 2020.

What we collect

When you buy the pack. Your name, email address and purchase details come to us through Payhip, which runs our checkout. Payment itself is taken by Payhip and its payment processor, Stripe. We never see or hold your card number or bank details. What you tick at checkout is recorded on your receipt.

When you email us. Whatever you put in the email, including problem reports and feedback about the pack. The pack asks you to send the problem only, and never your business information, client details, passwords or financial details. If you send us those anyway, we delete them.

When you use "Keep me posted". Your email address, stored by Netlify, which hosts this website. That list is used for two emails only: one when the beta closes and one when the full release lands. No newsletter, no sales sequence.

What we don't collect. Anything in your Brain. Your company details, contacts, rates, documents, jobs and chats live in your own Claude account and your own Microsoft or Google storage. We never see them, hold them or have access to them. This website runs no analytics and sets no tracking cookies.

What we use it for

To deliver the pack, send you updates to it, answer what you've asked us, and look at the gaps you report. Feedback about the pack may be used to improve it, as the Terms, section 2, explain. We don't sell, rent or share your information with anyone for their own use.

Who else handles it

Payhip and Stripe process your purchase under their own privacy policies. Netlify stores the Keep me posted list and serves this site, under its own policy. This site loads its fonts from Google, so Google's servers see your request for the page. Each of those is a separate company with its own terms, and we don't control them.

How long we keep it

Purchase records and your email address for as long as you're a beta buyer entitled to updates, and afterwards for as long as the law requires us to keep business records. Emails and problem reports for as long as they're useful to the pack. The Keep me posted list until the two emails have gone, or until you ask to come off it.

Your rights

You can ask us what personal information we hold about you, ask us to correct it, or ask us to delete it. Email hello@brainforbuilders.co.nz and we'll deal with it. If you're not happy with how we've handled your information, you can complain to the Office of the Privacy Commissioner at privacy.org.nz.

Changes

If this changes, the new version goes on this page with a new date. This version is dated 30 October 2026.
